Court summons IG, DCI to explain whereabouts of missing security expert Mwenda Mbijiwe

The High Court has ordered the Inspector General and DCI boss to appear on December 16, 2025, to explain the four-year disappearance of security expert Mwenda Mbijiwe in Kenya.

The High Court has summoned the Inspector General of Police and the Director of Criminal Investigations to personally appear and explain the whereabouts of security expert Mwenda Mbijiwe, who disappeared four years ago under unclear circumstances.

Justice Martin Muya directed the two senior officers, listed as the 2nd and 3rd respondents in the case, to present themselves before him on December 16, 2025, at 11:00 am.

"I have considered the application made by both sides and therefore order the 2nd and 3rd respondents to appear in Court physically on December 16 to explain the whereabouts of Mbijiwe," Justice Muya ruled.

Appearing before the Court, family lawyer Evans Ondieki told the judge that the State has failed to offer any meaningful update on investigations into Mbijiwe's disappearance.

Ondieki said Mbijiwe was arrested by police officers along Roysambu Road four years ago and has never been seen again.

"No explanation has been given regarding the purported investigations," the lawyer submitted, adding that neither the Directorate of Criminal Investigations nor the Office of the Director of Public Prosecutions had clarified whether Mbijiwe is alive or dead.

An investigation report previously forwarded to the DPP, the Court heard, did not establish who abducted Mbijiwe or the circumstances surrounding his disappearance.

Mbijiwe's mother also addressed the Court through an affidavit, stating that her son is being held incommunicado by the State.

She said she has visited numerous government offices in search of answers, but four years later, she has received no information on his fate.

Representing the Office of the Director of Public Prosecutions, Zachary Omwenga informed the Court that the ODPP intends to forward the investigation file to a magistrate's Court to initiate a formal inquiry into the disappearance.

He confirmed that the DCI report had not identified any individuals responsible for the abduction.

The Court also heard that at the time of his disappearance, Mbijiwe had declared an interest in contesting for the Meru gubernatorial seat.

According to submissions made in Court, "powerful leaders" in the country are suspected of being involved in his disappearance.

Justice Muya directed the matter to proceed on December 16, when the IG and DCI boss are expected to give a detailed explanation on the missing man's status.
